Though the Applicant is not described in the FIR by full name, he is described by the alias name as Balli. The arrested Accused persons with the help of others, have assaulted the First-Informant 1/3

Dayanand Manjulkar on 8th May, 2022 at about 11.00 a.m. It is below the Turbhe bridge. One unknown person came to him and there was some scuffle with the First-Informant. In that scuffle, the First-Informant lost Rs.20,000/- and one golden ring. For help, he called his friends.

The First-Informant was beaten by the arrested Accused and present Applicant with the help of wooden rod and sugar cane rod and with fist and blows. The First-Informant, his mother Chhaya, friend Anil and brother Karan were injured.

Charge-sheet is filed against some of the persons and some weapons are also recovered from them. Plastic pipe is yet to be recovered. FIR is of 8th May, 2022.

Considering the fact that the quarrel took place within a short span and considering the fact that the Applicant is not being named fully, I am inclined to grant him protection from the arrest. Even during the investigation, the involvement of the Applicant by full name is not disclosed. So, he needs to be granted protection from the arrest. In view of that, following order is passed :-

O R D E R

(i) Application is allowed.

(ii) In case of arrest in connection with C.R.No.164 of 2022 registered with A.P.M.C. Police Station - Navi Mumbai, the Applicant be released on furnishing Personal Bond and Surety Bond of Rs.25,000/-. (iii) The Applicant to give attendance to A.P.M.C. Police Station - Navi Mumbai on Monday from 10.00 to 12.00 noon until filing of charge-sheet.

(iv) Applicant not to threaten the Prosecution witnesses or to allure them in any manner.
