This is an application for pre-arrest bail as the applicant/accused is prosecuted for the offences punishable under sections 307, 143, 147, 148, 149 and 506 of the Indian Penal Code in C.R. No.571 of 2016 registered with Pandharpur Police Station, Pandharpur, District Solapur.

After hearing the learned Counsel for the applicant/accused as also the learned Prosecutor and after going through the complaint and papers, including the injury certificate and the police report, showing criminal antecedents of the applicant/accused, and when I expressed that I am not inclined to allow this application,
aba.445.2017_5.doc the learned Counsel for the applicant/accused submitted that he wants to withdraw the application.

I note that the police have not taken any action under the Criminal Procedure Code when the applicant/accused is absconding and avoided arrest when the offence is registered against him on 28.8.2016. The learned Sessions Judge to take note of this fact.

In view of the above, the Anticipatory Bail Application is allowed to be withdrawn and dismissed as such. (MRIDULA BHATKAR, J.)
