Learned Counsel for the Applicant on instructions at the outset makes a statement that he is not pressing the application on merits at this stage. However, he points out that the Applicant is in custody since 09/07/2013. The trial has already commenced, but the last witness was examined in July 2018. Considering this background, though the application is not pressed on merits, some directions are needed for expeditious disposal of the trial. Hence order:
ORDER
(i) The application is allowed to be withdrawn. It is clarified that no arguments were advanced on merits. However, the learned Trial Judge is requested to complete the trial as expeditiously as possible and preferably within a period of four months from today.
(ii) The Applicant is granted liberty to renew this application, if the trial is not completed within four months from today.
(iii) Application stands disposed of accordingly.
