We find that out of total 14 accused persons, 13 have already been arrested. Remaining accused Arshad has obtained interim bail in anticipatory proceedings and his anticipatory bail matter is coming up for hearing on 12/12/2018. 3.

Learned APP informs that against remaining accused persons, charge-sheet is already presented.

Learned Counsel for the Petitioner invites our attention to the order dated 19th April, 2017 passed by this Court and states that the witnesses are not coming forward as they are not protected. He claims that the witness summonses are already issued in the matter. 5.

By the order dated 19th April, 2017, this Court had permitted the Petitioner to provide a list of witnesses who apprehended threats and the Protection Branch was directed to provide necessary protection to such witness. The Petitioner can point out this order and the threats being extended to this witness to the trial Court. The trial Court is competent to take cognizance thereof and proceed further as per the law.

Anticipatory bail proceedings of Arshad are still pending. It is apparent that this Court, at this state, cannot issue any direction to the Investigating Officer in that connection. 7.

We, therefore, dismiss the present matter.
