The petition is filed on an apprehension that the recovery will be made from the Petitioner's salary.

The Petitioner was working as a Reader in the Department of Statistics of the Respondent- University of Mumbai. According to the Petitioner, on 28 July 2022, the recovery from the Petitioner's salary was proposed. However, that action was dropped in light of the communication dated 21 September 2022 and again on 11 May 2023, an indication has been given and as per earlier, the recovery might commence.

At this stage, there is no specific order against the Petitioner. Therefore, it is not necessary for us to enter into an academic issue as even the communication dated 11 May 2023 is not put in force till date. If any specific order is to be passed, we have no doubt that the order would be a reasoned one and will give adequate time before recovery is initiated. Therefore, keeping the question open in case such recovery is contemplated and order is issued, we dispose of the writ petition.
