This Application is moved for anticipatory bail. The applicant/accused is facing charges under sections 143, 147, 148, 149, 324, 452, 506 r/w. 34 of the Indian Penal Code and also under section 3(1) (x) of the Scheduled Castes and Scheduled Tribes Act. The offence is registered in all against 12 accused that they have assaulted the complainant and that some co-accused addressed the complainant by his caste.

The learned counsel for the applicants/accused has submitted that it is Babloo, Sagar, Shivaji and Nitin who have addressed the complainant by his caste and the specific roles in assault are attributed to them. He submitted that Babloo, Shivaji and Sagar are granted regular bail. He further submitted that the applicants are innocent and no specific roles are attributed to them.

Learned APP opposed the Application.

In view of the submissions of learned counsel for the applicants and the facts of the case, interim order passed by this Court is hereby confirmed on the same terms and conditions. The applicants are directed to attend the concerned police station on 16th April, 2015 between 4 p.m. to 6 p.m.
