This is another bail application for seeking temporary release of the applicant / accused on bail with a reason that he wants to give medical treatment to his ailing wife. On earlier occasion, the applicant/ accused was released on temporary bail for attending marriage of his brother.

10-APPA-401-2017.doc Heard the learned advocate appearing for the applicant/ accused. He pointed out certificates issued by Bhandari Hospital as well as Rural Hospital, Chakan, mentioning that his wife is suffering from PV bleeding with prolapsed uterus. Certificates are dated 14th July 2016. It is seen from the record submitted by the applicant/ accused himself that he was released on parole from 13th June 2016 to 5th August 2016. Thus, for the period, for which papers of medical treatment of wife of the applicant/ accused are placed on record and medical certificate of wife of the applicant/ accused are placed on record, he has already availed parole leave.

Bail application of the applicant/ accused on merit came to be rejected on 1st February 2016.

No case for grant of temporary bail is made out. The application is rejected.
