In view of the subsequent developments, the petitionerwife has moved the Family Court with the revised application seeking custody of the daughter on a ground that the husband is arrested in a crime and he being behind the bar is unable to take care of the children and abide by the order dated 20th April 2017 by which the custody was granted to the father and visiting the rights were conferred on the mother.

Since, the learned counsel for the applicant informs that of such an application has been moved before the Family Court, in N.S. Kamble page 1 of 2

3-caw-618-2018 the change circumstances, it would have appropriate if the Family Court deals with the said application. Liberty is granted to the petitioner to approach this Court in case of any adverse order prejudicial to her interest being passed.
