Though, the respondents are duly served, no one appeared on behalf of them when the matter called out.

This application is for bringing legal heirs on record of deceased respondent no.3 Raghunath Rama Satale, who died on 26.08.2011.

The learned counsel for the applicant submits that the wife of deceased respondent no.3A Smt. Akatai Raghunath Satale also expired.

7 cas 630-12=.doc Considering the submissions made by the learned counsel for the Applicant and the averments made in the Application, I am satisfied that the Applicant has made out a case for allowing the present Civil Application.

Hence, the following order:

a) Delay in preferring Civil Application is condoned.

b) Abatement is set aside.

c) Applicant is allowed to bring legal heirs on record of deceased respondent no.3 in Second Appeal (ST) no. 4808 of 2010 and pending Civil Application within six weeks from today, failing which the Civil Application shall stand dismissed without further reference to the court.

d) Civil application stands disposed off accordingly.
