This is an application seeking condonatin of delay in filing an application seeking leave to appeal challenging the judgment and order passed by Judicial Magistrate, First Class, Vashi at CBD Belapur in RCS No.1042 of 2015 vide judgment and order dated 28.8.2015 thereby acquitting the resopndents of the offence punishable under Sections 354 and 506 of IPC. There is delay of 119 days in filing the application. 2.

For the reasons assigned in paragraphs 9, 10 and 11, the delay deserves to be condoned in the interest of justice. Hence, the application is allowed in terms of prayer clause (a). Application stands disposed of. (SMT.SADHANA S.JADHAV, J.)
