This is an application under Section 438 Cr.P.C. filed by the aforesaid applicant seeking pre-arrest bail in C.R.No. 1 of 2022 registered with Mulund Police Station for offence under Section 353 of IPC.

The aforesaid Crime was registered pursuant to the complaint dated 01.01.2022, lodged by Ashlesha Mane, Typist attached to Metropolitan Magistrate's 53rd Court, at Mulund, Mumbai. 3.

The FIR prima facie indicates that the Applicant had applied for certified copy. He had some altercation with the complainant over issuance of certified copy.

Without prejudice to his rights and contentions, the Applicant states that henceforth he will not indulge in such activity. In the light of the said statement, and considering the nature of accusation and the P. Salgaonkar

13 aba 744-22.doc material in support thereof, in my considered view, this is not a case for custodial interrogation. Hence the application is allowed on the following terms and conditions:

(i) In the event of arrest of the Applicant in C.R.No. 1 of 2022 registered with Mulund Police Station, the Applicant be released on bail on furnishing bail bond of Rs.20,000/- (Rupees Twenty Thousand Only) with one or two solvent sureties in the like amount, to the satisfaction of the Investigation Officer.

(ii) The Applicant shall provide his permanent as well as temporary address, if any, and his contact details to the Investigating Officer. (iii) The Applicant shall not interfere with the complainant and the other witnesses in any manner.
