Heard learned APP for the State.

I have perused the records. The learned Magistrate has acquitted the accused mainly on the grounds, for want of identification and and further on the ground that there were no scratch marks or dents to the vehicle.

A perusal of the evidence of PW1 and PW2 prima facie reveals that these witnesses had identified the respondent as a driver of the vehicle involved in the accident. Their testimony prima facie reveals that the respondent had driven the vehicle at fast speed and dashed against the victim.

In view of the above, arguable points are raised. Hence appeal is admitted.
