After hearing for some time, advocate for petitioner filed application dated 25.02.2019 for withdrawal of the writ petition with liberty to file appropriate application for recalling the order dated 05.12.2018 passed by learned Member, Motar Accident Claim Tribunal, Thane in Claim Petition No.496 of 2012. The said application is duly signed by Power of Attorney of petitioner as well as advocate on record. Same is taken on record and marked 'X' for identification. Same is accepted. Hence, following order :

a) Writ petition stands disposed of as withdrawn. b) Liberty granted to the petitioner to file appropriate application before Motar Accident Claim Tribunal, Thane in Claim Petition No.496 of 2012 for S.C.Magar

c) If such application is filed, that to be decided on its own merits without influencing by the order passed by this Court.

d) No order as to costs.
