This is an application for fixing appeal for hearing. It is submitted that applicant is a medical professional. He has been convicted for the offence u/s.304 of Indian Penal Code. He has good chance of succeeding on merits. On account of conviction the applicant is not in a position to practice his profession. 2.

Learned APP strongly opposed the application. It is submitted that the applicant has been granted bail by order dated 3rd February 2021 by suspending sentence and the appeal has been admitted recently.

The submissions of learned APP deserve to be accepted. The appeal is admitted recently and the applicant is on bail. No ground for taking up appeal out of turn is made out. Interim Application is rejected.
