The application is filed by the wife to transfer the Marriage Petition No.1255 of 2021 pending before the Family Court in Pune to the Family Court in Yavatmal.

The marriage between the applicant and respondent was solemnized on 3rd June, 2013. Due to matrimonial disputes between the applicant and respondent, the respondent filed Marriage Petition No.1255 of 2021 under section 13(1)(ia) and (ib) of the Hindu Marriage Act, 1955 on 7th April, 2021. 3.
The applicant has, therefore, filed present application seeking transfer of above proceeding filed before the Family Court in Pune to the Family Court in Yavatmal. According to the
31-mca254-2022.doc applicant though she is working in Nagpur, her parents are staying in Yavatmal. Her permanent residence is at Yavatmal. The distance between the Nagpur and Pune is around 711 kms. and it takes about 14 to 15 hours to travel. She, therefore, sought transfer of proceeding to the Court in Yavatmal.

For the reasons stated above, the applicant has made out the case for transfer of proceeding.

The application is, therefore, allowed in terms of prayer clause (a).
