P.C.:- By an order dated 12th March, 2018, the Applicant was granted interim relief.
Heard the learned counsel appearing for the Applicant and the learned APP. Perused the record of investigation. The first information report itself mentions that the principal accused Vilas Navrat signed the receipt of acceptance of gold from the first informant. It is the prosecution case that, the Applicant is the real brother of the said Vilas Navrat and was present at the office of Vilas when Vilas accepted the delivery of the said gold. The record further indicates that, the Applicant is running his independent 1/2
ssm 2 910-aba472.18.sxw business and is dealing imitation jewellry under the name of M/s. Vshine Fashion Jewellry LLP.
Prima facie, it appears that the Applicant has no direct concern with the present crime and he has been implicated in the present crime only because he is brother of Kiran and was present on one or two occasions at the business establishment of Kiran. In view thereof, the Applicant is entitled to be protected by pre-arrest bail.
Interim relief granted by order dated 12th March, 2018 is hereby confirmed. However, the condition to attend the Investigating Officer of M.H.B. Colony Police Station, Mumbai is waived. Application is allowed in the aforesaid terms. (A.S. GADKARI, J.) 2/2
