The prayer of the petitioner is for premature release. As per the Rules, the case of the petitioner was referred to the State Government for considering his case for premature release. The case of the petitioner has been considered by the

jdk 2 5.cr.wp.1130.17_appw.290.17.j.doc State Government and he has been categorized as falling in category 6(a) of the 1992 Guidelines and in category 6(a) of the 2010 Guidelines. The copy of the order dated 30.1.2018 is taken on record and marked "X" for identification. Both the Guidelines state that the petitioner will be released from prison after completion of 28 years of imprisonment including remission. In case, the petitioner is aggrieved by the said categorization, it would be open to him to challenge the same. No further orders are necessary at this stage, hence, Rule is discharged. Petition is disposed of.

In view of the disposal of the petition, Criminal Application No. 290 of 2017 does not survive and is disposed of as such.
