DATED : 12 APRIL 2023 P.C. :- This is an application filed under Section 438 of the Code of Criminal Procedure, 1973 for anticipatory bail. 2.
The applicant is apprehending his arrest in Crime No. 76 of 2022 registered at Uran Police Station, Navi Mumbai for the offences punishable under Sections 406, 420, 504, 506 of the Indian Penal Code. 3.
The allegations against the applicant are of non-return of Excavator owned by the wife of the complainant which was sent to his workshop for repairing.

The learned counsel for the applicant submits that after repair, the Excavator was handed over to one Durga Rao through whom it was MJ Jadhav 1 / 2
22-ABA-741-23.odt received. The learned counsel for the applicant submits that the applicant without prejudice to his rights just to show his bonafides is even ready to deposit the amount of Rs. 5 Lakhs before this Court. 5.
Considering the overall facts and circumstances of the case, I am inclined to release the applicant on anticipatory bail. Hence, the following order is passed:
(i) Application is allowed.
(ii) In the event of arrest of applicant in in Crime No. 76 of 2022 registered at Uran Police Station, Navi Mumbai for the offences punishable under Sections 406, 420, 504, 506 of the Indian Penal Code, he shall be released on bail on furnishing PR bond in the sum of Rs. 25,000/- with one or two sureties in the like amount.
(iii) The applicant shall attend the concerned police station as and when called by the Investigating Officer and shall co-operate in the investigation. (iv) The applicant shall deposit the amount of Rs. 5 Lakhs before this Court within four weeks from the date of uploading of this order.. ( N.R. BORKAR, J. ) MJ Jadhav 2 / 2
