It is not in dispute that three matrimonial proceedings are pending in the Court at Shrigonda in Ahmednagar district whereby the transfer of divorce proceedings is sought. 2.

The applicant is custodian of minor child aged about two and half years. It will be in the interest of both the parties that the transfer should be granted as the court will be precluded from recording evidence repeatedly on the same issue. Furthermore to avoid recording of contradictory findings, transfer and clubbing of the matter is very much required.

That being so, application is allowed in terms of prayer clause (a).

The Court below is directed to post all the four matters on the very same day, so that it will be convenient for the parties to attend the proceedings.

Transfer of proceedings will not preclude the parties to approach before the mediation.
