By this Civil Application, the applicant seeks stay to the execution and implementation of the judgment and award dated 16th September, 2016 passed by the learned Member, Motor Accident Claims Tribunal, Baramati in M.A.C.P. No. 95 of 2014. 3.

The learned Counsel for the applicant submitted that pursuant to the judgment and award dated 16th September, 2016, the appellant/owner of the vehicle has deposited the entire decretal 1 / 2

510.CAF1887_2017.doc amount along with interest accrued thereon Rs.13,23,084/-. He, therefore, prays that the impugned judgment and award be stayed. 4.

As the entire decretal amount along with interest is deposited as per the submissions of the learned counsel for the applicant, the judgment and award dated 16th September, 2016 is hereby stayed till pending Appeal.

Civil Application is allowed and is accordingly disposed of. 6.

In First Appeal, issue notice to the respondents, returnable on 8th November, 2017.
