Learned counsel for the applicant submits that this is subsequent bail application preferred on the changed circumstances, as when his earlier application was rejected on 22nd November, 2017, applicant had undergone 2 years and 8 months of sentence, while as on date he has undergone about 4 years and 8 months of sentence against Rigorous Imprisonment of Sonali Patil

2/2 24 appa 357 of 2019.doc 7 years imposed upon him for the offence punishable under Section 4 of Protection of Children from Sexual Offences Act, 2012.

Learned counsel for the applicant however, refers to the paragraph 7 of the earlier order dated 22nd November, 2017 and seeks time to take appropriate steps, in view of leave granted to applicant to file application for early hearing. Learned counsel in view of above, seeks leave to withdraw the application with liberty to file afresh for bail, in the event for any reason application for early hearing is rejected. Accordingly, following order is passed:-

ORDER

Leave as prayed is allowed. Application stands disposed of as dismissed as allowed to be withdrawn with liberty as prayed for to file afresh application, if application for expeditious hearing is rejected. (P. N. DESHMUKH, J.) Sonali Patil
