By the order dated 10.01.2019 passed by the respondent No.3, the petitioners have been externed for the period of one year from Sangli, Satara, Kolhapur District under Section 55 of the Maharashtra Police Act. This order is challenged by the petitioner under Section 16 of the said Act by filing Appeal bearing No.16 of 2019 before the respondent No.1 Divisional Commissioner, Pune Division, Pune.

The short grievance of the petitioner is that though the said Appeal is filed on 29.01.2019 along with application for stay, no orders are passed thereon as on today.

In the above backdrop we deem it convenient to dispose of the petition by directing the respondent No.1 to dispose of the application for stay as expeditiously as possible, and in any case, within a period of two weeks from the date of receipt of this order, in accordance with law.

Order accordingly.

It is expressly made clear that we have not gone into the merits of the matter and this order should not be construed as an expression on merits and all points and contentions of all parties are kept open.
