For the reasons separately recorded, we pass the following order:

ORDER :

(a) The Rule is made absolute in terms of prayer clause (a) which reads this:

"(a) that the order dated 2nd August 2010 passed by the Ld. Metropolitan Magistrate, 16th Court, Ballard Pier, Mumbai in 6/Misc./2010 may be quashed and set aside and the FIR being M.E.C.R.No.4/2010 registered with Yellow Gate Police Station, Mumbai be quashed and set aside."

(b) All concerned to act upon an authenticated copy of this order.
