DATE : 15th JUNE, 2017.
P. C. :
The application is filed for quashing the FIR bearing CR No. 166 of 2016 registered with Miraj Gramin Police Station, Sangli. The said FIR is registered at the instance of the respondent No.2 for the offences punishable under Sections 324, 341, 143, 147, 148, 149, 427, 504, 506 and 323 of the Indian Penal Code, 1860 (for short " the IPC"). The FIR is annexed at page 18 and the statement of the first informant is at page
22. We have perused the same. The FIR does disclose commission of cognizable offence under Section 341 of the IPC and, therefore, we are not inclined to quash the subject FIR.

The learned counsel for the applicants submitted that the petitioner had also filed a complaint which is registered as NC Complaint and the present FIR is a counterblast. He submitted that the same is mala fide. We cannot consider these submissions at the stage of quashing.

In the light of the above, we find no merit in the petition and the same is, accordingly, dismissed.
