On verification of cause title of First Appeal and its Civil Application with title of original proceedings, it is seen that address of Respondent No. is one and the same. Respondent No.3 herein was Opponent No.2 before the Tribunal. The Notice issued to Respondent No.3 is received unserved with remark "Respondent No.3 was not found, on inquiries, there is no any person by the name of R.No.3 and they do not known about R.No.3". It is evident that Respondent No.3 cannot be served by
Office Notes, Office Memoranda of Coram, appearances, Court's orders or directions and Registrar's Orders Court's or Judge's orders regular mode of service. Hence, there is no other way of Publication of Notice in local Newspapers as mentioned in prayer clause of Civil Application.
In view of this, Civil Application is allowed in terms of prayer clause (b). Issue Publication Notice to Respondent No.3 returnable after 8 weeks.
