It is an appeal against the judgment of acquittal passed by the Court of Metropolitan Magistrate, Mazgaon for the offence punishable under Section 138 of the Negotiable Instrument Act, 1881. During pendency of this appeal, appellant has received certain amount. Now, the company do not want to prosecute this appeal further. The representative of the appellant is present. In view of that appeal is disposed of for non prosecution. 2.
