Heard. This appeal is preferred by Defendant challenging the order dated 16/02/2006 passed by the Bombay City Civil Court, Mumbai in Notice of Motion No.4851/2013 directing the Court Receiver to put the Plaintiff in possession of the suit premises by executing tenancy agreement. 2.

This court (Coram : A. M. Khanwilkar, J. as he then was) by order dated 05/05/2006 directed both the parties to maintain status-quo. Both the counsel submit that the trial of S.C.Suit No.9552/1991 is already commenced.

Considering the fact that the trial in S.C.Suit No.9552/1991 already started, following order is passed:

a.

Parties are directed to maintain status-quo till hearing and final disposal of the S.C.Suit No.9552/1991 as per order dated 05/05/2006 passed by this court.

b.

Trial Court to decide S.C.Suit No.9552/1991 as early as possible but in any case on or before 31/12/2015.

c.

Appeal from Order stands disposed of accordingly.

d.

Civil Application stands dismissed as infructuous.
