Heard. By this petition under Article 227 of the Constitution of India the Petitioner challenges the order dated 22.01.2016 passed by the learned District Judge and Additional Sessions Judge, Nasik below Exhibit- 9 in Civil Appeal No.30/2012.
The learned counsel for the Petitioner submits that subsequently Respondent No.1 Dadu Devman Ahire filed pursis at Exhibit- 23 before the learned District Judge in the said appeal stating that he did not want to proceed with the appeal and that the appeal may be disposed of. That pursis was accepted by the District Judge and passed order dated 23.09.2016 dismissing the appeal for want of prosecution. To that effect he has placed on record a photocopy of the pursis as well as a copy of order Basavraj G. Patil 1/2
903.6310.16-wp.doc dated 23.09.2016. Same is taken on record and marked "X" for identification. He submits that in view of subsequent development, nothing survives in the Writ Petition. Same is accepted.
The Writ Petition stands disposed of as infructuous. No order as to costs.
