The applicant was granted bail by this Court by order dated 30th October 2018 passed in Bail Application No.1426 of 2018 on executing PR bond in the sum of Rs.20,000/- with one or more sureties in the like amount.

The advocate for applicant submits that the applicant has furnished documents relating to surety, however, the process of furnishing surety is not yet completed. It is submitted that although the applicant has been granted bail by order dated 30th October 2018, he has continued to be in custody. It is submitted that the applicant is in custody from 29th December 2017. It is therefore prayed that the applicant may be granted cash bail surety for a temporary period to enable the applicant to furnish surety in accordance with aforesaid order.

Considering the above submissions, I pass following order :

ORDER

(i) The order dated 30th October 2018 in Criminal Bail Application No.1426 of 2018 is modified and the applicant is permitted to furnish cash security in the sum of Rs.25,000/- for a period of six weeks to enable the applicant to furnish surety in accordance with order dated 30th October 2018;

(ii) Criminal Application No.368 of 2019 is disposed off. (PRAKASH D. NAIK, J.) MST
