Heard the learned counsel for the parties.

This Contempt Petition is filed by claimant for non-compliance of order dated 11.3.2011 passed by this court in First Appeal (ST) No.12918 of 1995.

The learned counsel for the petitioner submits that this court by order dated 11.3.2011 directed respondent State of Maharashtra to deposit entire decreetal amount in the Reference Court within two weeks from today. As they failed and neglected to do so, claimant filed the present Contempt Petition.

10 cp153-12.doc submits that the State of Maharashtra deposited entire decreetal amount in the Reference Court on 3.9.2012. He submits that they deposited sum of Rs.28,23,333/- after deducting TDS.

The learned counsel for the petitioner submits that he received instruction from his client to withdraw the present Contempt Petition in view of subsequent developments with liberty to file appropriate proceeding before the executing court if some amount is deficit. Same is granted.

Contempt Petition is dismissed as withdrawn with liberty as prayed.
