By order dated 27th February 2023, learned Magistrate issued non-bailable warrant against the petitioner. The petitioner appeared before the learned Magistrate on the next date and requested for cancellation of warrant. The learned magistrate directed said application to be kept on scheduled date that is 20th March 2023.

The petitioner is a woman in a complaint under section 138 of the Negotiable Instruments Act, 1881. Considering the facts of the case, accepting the undertaking on behalf of the petitioner that she will remain present on 20th March 2023, the order of issuance of non-bailable warrant against the petitioner is set aside. 3.
