Heard learned Counsel for the petitioner and the learned A.P.P. 2.

Petition is filed for quashing the proceedings against the petitioner in FIR No. 345 of 2015 registered with Sinhagad Road Police Station, Pune City.

Learned A.P.P having taken instructions, makes a statement that after investigating into the said FIR, Sinhagad Road Police Station, Pune City, have filed C-Summary report before the Judicial Magistrate First Class, Shivaji Nagar, Pune and the same is pending. In support of his SQ Pathan 1/2

wp.1094.16.34.doc contention, he placed on record report dated 14th March, 2017 by Assistant Police Inspector, Sinhagad Road Police Station, Pune City. The said report is taken on record.

In the light of the statement made by the learned A.P.P and the report dated 14th March, 2017, learned Counsel for the petitioner agrees that his grievance no more survives and seeks leave to withdraw the petition. Leave granted.
