The Petition is filed for quashing the proceedings of R.C.C.No.361 of 2014 pending on the file of the learned JMFC, Khadki, Pune and in the alternate, direction is sought to transfer the said case from the Court of JMFC, Khadki, District - Pune to the Court of JMFC, Miraj, District - Sangli. Mr. Saste pointed out that the petitioner has filed application for transfer at exhibit-37 in the said case which was rejected on 02.02.2015 on the ground that the charge is already framed against the petitioner on 17.11.2014.

Since the said case is at the advanced stage of hearing, we are not inclined to entertain this Petition and the same is accordingly dismissed. Petitioners, however, are at liberty to apply for exemption from appearing before the JMFC Court. In the event, such application is filed, the same shall be considered sympathetically.
