:

1.

Heard learned counsel for Respondent No. 4 and learned AGP for Respondent Nos. 1 to 3.

2.

In the present petition, the Petitioner has challenged the impugned order dated 18.02.2017 passed by the learned Additional Commissioner, Mumbai pertaining to the election of the members of Respondent No. 5 - Grampanchayat Bhadane of which the Petitioner was one of the members.

3.

Learned counsel for Respondent No. 4 submits that the tenure of Panchayat Samiti of Respondent No. 5 - Grampanchayat has come to an end and hence, the relief prayed for in the petition has become infructuous.

4.

Prima facie, on reading of the impugned order dated 18.02.2017 it appears that the tenure of the Panchayat Samiti of Respondent No. 5

27a. civil wp 3202-17.doc - Grampanchayat has come to an end. Admittedly, the only relief sought for in the petition is challenge to the impugned order dated 18.02.2017. In view thereof, the learned counsel for Respondent No. 4 appears to be right in her contention.

5.

In view of the above, the writ petition stands dismissed as it has become infructuous. Liberty to apply.
