1] After hearing the learned counsel for the appellant at length, when this Court expressed its disinclination to interfere with the impugned Order dated 9th February 2018 passed below Exhibit-5 in Special Civil Suit No. 272 of 2017 by the learned 3rd Jt. Civil Judge Senior Division, Nashik, the learned counsel, on instructions, seeks leave to withdraw the present appeal unconditionally.
Leave granted.

Civil Judge Senior Division, Nashik, seized of Special Civil Suit No. 272 of 2017 is hereby requested to expedite the hearing of the said Suit and to conclude the same within a period of 18 months from the date of receipt of the present Order.
5] The Trial Court shall not get influenced by withdrawal of the present Appeal by the appellant and shall hear the Special Civil Suit No. 272 of 2017 on its own merits.
