By consent of the parties, Civil Application No.1374 of 2015 is heard forthwith. By separate order passed by this Court, the second appeal has already been admitted on the substantial questions of law formulated by this Court.

For the reasons recorded in the civil application, civil application is made absolute in terms of prayer clause (a). No order as to costs.

The respondent no.1 being 90 years old, place the second appeal on board for 'hearing and final disposal' in the week commencing from 21st November 2016.
