This application is moved for pre-arrest bail on the ground of apprehension. Mrs. Sayali Pavan Mulay, the wife of applicant no.1, who has approached the police and applicant no. 1 was called at the police station. The applicant-husband has also approached the police and at his instance three NCs were registered against the wife and her family members. As applicant no.1 has been asked to attend the police station, the applicants approached the learned District and Sessions Court, Pune for pre-arrest bail, which was rejected by the learned Sessions Judge on 10th March 2017. The said order was placed before me.

It is the case of the prosecution that the complainant and applicant no.1- husband got married on 26th January 2015. However, their relationship is strained and therefore, she approached the police. 3.
The learned APP has submitted that the offence is not registered against the applicants.

The learned counsel for the applicants has submitted that they have received a letter dated 9th March 2017 from A.P.I., Kondhava Police Station, Pune. He has further submitted that the applicants-accused have serious apprehension that if they visit the police station, the police are likely to arrest them.

Perused the order of the learned District and Sessions Judge, Pune. There is a matrimonial dispute. Hence, the Anticipatory Bail Application is disposed of with the following order.
ORDER
The police of Kondhava Police Station, Pune are directed to give 72 hours notice to the applicants-accused, if they want to arrest them after filing of the F.I.R. 6.
Anticipatory Bail Application is disposed of in the above term. (MRIDULA BHATKAR, J.)
