At the outset, the learned counsel for the applicants/appellants states that he has fled an interim application for stay, but the same is fled as part of Appeal from Order and, therefore, is not registered separately. He, therefore, seeks permission to segregate the same and get it numbered.

Heard the learned counsel for the applicants and perused the application, which seeks condonation of delay of 11 days in instituting the appeal.

On perusal of the application, it can be seen that the impugned judgment is delivered on 21/01/2022 and the certifed copy is received on 24/01/2022. The applicants explained that some time was consumed in seeking legal advise and the appeal came to be instituted on 04/03/2022. This has resulted in delay of 11 days. On hearing the learned counsel for the applicant, I am convinced to condone the delay. The application is allowed in terms of prayer clause (a). APPEAL FROM ORDER (ST) NO.6993 OF 2022 4.

Issue notice to the respondents, making it returnable on 09/06/2022.
