The learned APP upon instructions submits that the trial has progressed and as on today, the investigating officer is being examined. In view of this, it would not be appropriate to consider the application under section 439 of the Code of Criminal Procedure, 1973. The learned Counsel for the applicants also fairly accepts the said position and seeks liberty to withdraw the applications. Liberty as prayed for is granted in the interest of justice.
