This is an application seeking condonation of delay in filing an application seeking leave to appeal challenging the Judgment and Order passed by 5th Judicial Magistrate First Class, Thane in S.C.C. No. 1019 of 2014 wherein respondent has been acquitted for offence punishable under section 138 of Negotiable Instruments Act vide Judgment and Order dated 09/10/2015. The delay is of 94 days. 2) For the reasons assigned in paragraph nos. 7 to 11, application seeking condonation of delay deserves to be allowed in the interest of justice.
