On hearing the learned counsel for respondent No.3, we are inclined to dispose of the present petition as the petitioner is stated to be the tenant of the premises in question and as the petitioner has remedy to invoke the provisions of the SARFAESI Act in view of the decision of this Court in Writ Petition (O.S.) No. 2755 of 2016 (M/s Chhindwara Infrastructure Pvt Ltd Vs. The State Bank of India) dated 28th November, 2016. In view of this the present petition is disposed of with liberty.
