P.C.:- The Applicant is arrested on 25th October, 2013 in CR No. 256 of 2013 dated 16th October, 2013 registered with Bangur Nagar Police Station, Mumbai under Sections 302 and 397 of the Indian Penal Code. The investigation of the said crime has now culminated into the Sessions Case No. 25 of 2014. It is submitted that, the Trial Court has framed charge on 12th February, 2015 and as of today approximately 15 witnesses have been examined by the Prosecution. The learned APP, on instructions, submitted that the prosecution is intending to examine about 7 more witnesses in 1/2

ssm 2 51-ba628.18.sxw support of its case and it may take approximately 4 months time to conclude the trial.

In view of the statement made by the learned APP, the learned counsel appearing for the Applicant, on instructions, seeks leave to withdraw the present Application with liberty to file a fresh Application for bail before the Trial Court, if the trial pertaining to Sessions Case No. 25 of 2014 is not concluded within a period of six months from today.

Leave and liberty granted.

Application is disposed off as withdrawn with aforesaid liberty.
