1.
This PIL petition dated 16th March 2012 urges this Court to examine the records and proceedings of the respondent no. 2/Municipal Corporation in entering into a contract with the respondent no. 3/company.
2.
Mr. Mankapure, learned advocate for the respondent no. 2/Municipal Corporation submits that the contract has been terminated in 2013, whereafter the respondent no.
3/company has initiated legal proceedings which the Civil Court is seized of. It is also submitted by him that the civic facility centre is now being operated by the respondent no. 2/ Municipal Corporation.
3.
Dr. Warunjikar, learned advocate for the petitioners, though submits that they have not contacted him for quite J.V.Salunke,PS
16-PIL.86.2012 some time, urges this Court to require the respondent no. 2/Municipal Corporation to file an affidavit placing on record the facts as submitted by Mr. Mankapure.
4.
Having heard learned advocates for the parties and taking note of the fact that the contract between the respondent no. 2/Municipal Corporation and the respondent no. 3/company no longer subsists and also that civil proceedings are pending between the two of them, we find that this PIL petition has been rendered infructuous in view of intervening events. The same stands disposed of without costs; however, this order shall not preclude the petitioners to espouse their grievance before the appropriate forum if at all the submission of Mr. Mankapure is demonstrably incorrect.
