Learned counsel for complainant- intervener has referred to afÏdavit of complainant whereby it is brought on record that due to misunderstanding complaint came to be lodged against applicant and at no pointy of time applicant has threatened or extorted or demanded any money from complainant. Accordingly complainant withdraw his complaint. Learned counsel for applicant, in the background of above facts also makes a statement that applicant has moved for quashing of FIR. 2.

Record reveals that applicant was protected by interim directions in view of statement made by complainant as mentioned in the afÏdavit. In that - Page-1/2

Nalawade 15-aba-582-19.doc view of the matter, though interim order dated 11.3.2019 is liable to be confirmed, applicant since has put investigating machinery into motion, learned APP makes a statement that investigation is almost complete and charge sheet is likely to be filed shortly, interim order is confirmed subject to complainant who is said to be builder paying costs of Rs.25,000/- on or before 16.4.2019 with the Registrar of this Court. On depositing costs, same be equally distributed in favour of Police Welfare Fund, Navi Mumbai Police Commissionerate and Kirtikar Law Library, High Court, Bombay.
