1] The applicant is granted interim relief by an Order dated 27th March 2017. 2] The first information report is lodged by Mr. Rakesh J. Jain. It is the prosecution case that, during the period of demonetization the accused persons namely Amit Soni, Kunal Parekh and other accused persons by posing as R.B.I. Bank Officer lured the complaint and under the pretext of change of old currency to part with old notes on certain commission and called the complaint at the spot. When the complaint reached at the spot, the accused persons deceitfully took the said amount and tried to escape from the spot by giving threats that they will call the police. At that time the complaint caught hold one accused person namely Iliyaraja. When the said incident was going on the real police reached at the spot and apprehended co-accused Iliyaraja. In the premise the first information report is lodged.
3] I have perused the papers pertaining to the investigation. It is to be noted here
Dond 2/2 aba.465-2017.sxw that, the police have also arrested Amit Soni and Kunal Parekh. The role attributed to the present applicant is that, he introduced the complaint with co-accused Amit Soni and Kunal Parekh. Prima facie it appears that apart from the said fact, the applicant has no other role to play in the present crime. It appears that the applicant, with bonafide intention, introduced the complainant with the said two accused persons without having the knowledge that other co-accused persons may further indulge in the present crime.
4] In view thereof, the applicant has made out a case for his pre-arrest bail. The interim relief granted by an Order dated 27th March 2017 is hereby confirmed. However, the applicant shall attend the Investigating Officer as and when called for between 11.00 a.m. to 2.00 p.m and to join the process of investigation till the submission of chargesheet.
