The Appeal challenges the order dated 11 February 2022 passed by the learned City Civil Court in Notice of Motion No.613 of 2022 in Civil Suit Stamp No.1378 of 2022. By the impugned order while dispensing with the Notice under Section 80 of the Civil Procedure Code, the Notice of Motion was fixed for filing reply and the earlier order of status-quo granted on 10 February 2022 has been continued.

A perusal of the order dated 10 February 2022 shows that it is based on the order passed by this Court in AO No.86 of 2022.

Be that as it may, the learned counsel for the Appellant submitted that the only challenge is to the part of the order continuing the order of status-quo.

The learned counsel for the Appellant states that the reply has been filed to the Notice of Motion and thus, the hearing and disposal of the Notice of Motion can be expedited. This is the only limited prayer made at this stage.

In such circumstances, the Appeal is disposed of. No order as to costs.

The City Civil Court shall hear and decide the Notice of Motion No.613 of 2022 as expeditiously as possible and preferably within a period of 12 weeks from the receipt hereof. The order of status-quo shall continue during the pendency of the Notice of Motion.

The rival contentions of parties on merits are left open.
8.
Pending Interim Application is disposed of.
