Heard the learned APP and the learned Counsel for the respondents. Perused the evidence.

The prosecution has made out a case for admission of the appeal. Hence, the application seeking leave to appeal is allowed and disposed of accordingly.

Appeal admitted.

Action under section 390 of the Code of Criminal Procedure, 1973 be initiated.

The respondents shall appear before the learned Special Judge, Barshi on or before 20/11/2019 and furnish bail to the satisfaction of the Special Judge, Barshi.

19.als33.17.doc The respondents shall continue to appear before the learned Special Judge, Barshi once in 6 months on the date assigned by the learned Special Judge, Barshi. Upon failure to attend any two consecutive dates by the respondents, learned Special Court, Barshi shall intimate the same to the High Court, Mumbai and the prosecution is at liberty to move for cancellation of bail.
