Rule in both the Petitions, with the consent of the learned counsel for the parties made returnable forthwith.

The learned counsel for the parties have tendered Minutes of the Order by Consent dated 29/6/2015 evidencing the settlement between the parties. The said Minutes of the Order by Consent have been signed by the Executive Engineer of the Petitioner and the Partner of the Respondent No.1. lgc

wp-782.15 The learned counsel pray that the above Petitions be disposed of in terms of the said Minutes of the Order by Consent. The Executive Engineer of the Petitioner Shri Sanjeev Chaudhari is personally present in Court, and the Partner of the Respondent No.1 Shri Ramchandra More is also personally present in Court. Both of them state that the said Minutes of the Order by Consent are acceptable to the Petitioner and the Respondent No.1 and that they have signed them of their own free will and volition. The learned counsel for the parties have identified the Executive Engineer of the Petitioner and the Partner of the Respondent No.1 respectively. The said Minutes of the Order by Consent have been signed by the learned counsel for the Petitioner and the Respondent No.1. The said Minutes of the Order by Consent are taken on record and marked "X" for identification. Both the Petitions are disposed of in terms of the said Minutes of the Order by Consent.

In view of the disposal of the above Petitions, Civil Application No.937 of 2015 filed in Writ Petition No.782 of 2015 would not survive and the same to accordingly stand disposed of as such. [R.M.SAVANT, J] lgc
