Yesterday after dictating the matter partly, on inquiry about availability of case diary, learned APP submitted that Investigating Officer is not present.

Today, Learned APP has produced case diary. Perusal of injury report of Sarita, wife of the complainant reveals that she has sustained fracture of third proximal phalanx while the complainant is also certified to have sustained two abrasions over right elbow, trauma over right shoulder, right foot, right knee, right thigh, right side of chest and trauma over left ear, which are certified to be grievous injuries. Statements of injured substantially corroborate the injury report. 3.

There is prima facie material to show involvement of applicant as assailant of complainant and his wife after extending threats to them as stated in their statements.

In that view of the matter, no case is made out for grant of anticipatory bail. Therefore, application is rejected. Case diary is returned back to learned Additional Public Prosecutor. (P.N. DESHMUKH, J)
