Criminal Application Nos.340 to 342 of 2016 are not on board, taken on board and heard along with Criminal Application Nos.285 to 287 of 2016.

Learned Counsel for the Applicant states that all the applicants in the aforesaid applications are independent non-executive Directors of GEI Industrial Systems Limited. He submitted that the applicants have been arraigned as accused and process has been issued against them by the learned Metropolitan Magistrate, 58th Court, Bandra, Mumbai in C.C.Nos.3852/SS/2015; 3853/SS/2015 and 3854/SS/2015 respectively. 3.
Learned Counsel for the complainant does not dispute the fact that all the applicants in the aforesaid applications are independent nonexecutive Directors of GEI Industrial Systems Limited. He submits that the complainant does not wish to pursue the complaints, qua the present applicants. The said statement is accepted.

In view of the said statement, the impugned orders issuing process, passed by the learned Metropolitan Magistrate, 58th Court, Bandra, Mumbai are set aside and complaints being C.C.Nos.3852/SS/2015; 3853/SS/2015 and 3854/SS/2015, are quashed and set aside, qua the applicants.

The Applications are allowed in the aforesaid terms and are accordingly disposed of.
